dnr rule book reads that cannot set connibears within 200 yrds of entry to private drive serving residence without permission, but then says you can set them within 200 yrds of inhabited buildings if they are submerged, but not within 200 yrds. of entry to drive?with out permission? even if submerged? that is it what it seems to mean or is written, so i cannot set a 110 connibear submerged completely, within 200 yrds. of the entry to a private drive serving a residence? not sure,but passed up alot in past of good rat,mink and some beaver spots because you have to have permission if trap is submerged the way it is written? passed up on good mink spot by tile, lots mink sign, were it was so rocky and drowning set with foothold could not be made,today,yet was good channel to submerge 110s in on be plate, because it was within 100 yrds of long driveway and did not want to bother someone asking, alot people dont like someone coming to there door, i know i would not

You cannot set or maintain any snare or conibear-type trap within any public road right-of-way within 200 yards of buildings inhabited by humans unless a resident of the dwelling adjacent to the public road right-of-way has given permission, or unless the body-gripping or conibear-type trap is completely under water or at least one-half of the loop of the snare is under water. I think the "or Unless" is the key word here. I personally will set 110s in water within 200 yards of a drive. If you have questions about the law ask your C.O. cause he is the ticket writer. LLL

The way I read the law as it is written is that you can set a conibear in the ROW as long as it is completely submerged under water. If you wanted to set a conibear above water then you would have to have permission from any residents living within 200 yds. I set #110's this season that were within 200 yds of a house but kept them under water.

As explained by LLL and arcman was what the entent of the regulation was entended to be and I have not heard of it being enforced any differently.

I personally would not sweat it if it was an underwater set Grandpa. The chances of a swinging critter would not be likely. LLL

Distance from the fence is another issue also outside the 200 yards.
