Sorry Hardwired, tried to fix it HOUSE FILE BY TYMESON A BILL FOR 1 An Act prohibiting setting or maintaining traps within a public 2 road right=of=way without prior permission of the adjacent 3 landowner or tenant and providing a penalty. 4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: PAG LIN 1 1 Section 1. Section 481A.92, subsection 3, Code 2009, is 1 2 amended by striking the subsection and inserting in lieu 1 3 thereof the following: 1 4 3. A person shall not set or maintain any type of snare 1 5 or trap within any public road right=of=way unless the owner 1 6 or tenant of the land adjacent to the public right=of=way has 1 7 given permission. 1 8 EXPLANATION 1 9 This bill prohibits the use of any type of snare or trap 1 10 within any public road right=of=way unless the owner or tenant 1 11 of the land adjacent to the public road right=of=way has 1 12 given permission. Currently, a person must obtain the prior 1 13 permission of the occupant of a residence whose private drive 1 14 entry is within 200 yards of where a conibear=type trap or 1 15 snare will be set. 1 16 "Public road right=of=way" means an area of land, the right 1 17 to possession of which is secured or reserved by the state 1 18 or a governmental subdivision for roadway purposes. The 1 19 right=of=way for all secondary roads is 66 feet in width, 1 20 unless otherwise specified by the county board of supervisors 1 21 of the respective counties. 1 22 A violation of the new provision is punishable by a scheduled 1 23 fine of $25. I clicked on the link but it does not give her web address. I see she is on a sub-commitee for the DNR. How does this happen. I did not see anything that qualifies her to be able to propose this or am I missing something? WE can't let this come to be or you won't be hunting or anything in the right of way. Ask NE how much they liked it when they could not trap the right of way. With Rep. Tymeson being elected under a Rep. party how does her constituites feel about her trying to take rights away from people?Grand Old Party

The many times I have been down to the capitol I have seen one thing theres a fine line between Republicans and Democats but theres a big divide between Liberals an Conservatives. Thats just been one thing I have seen sitting in the balcony watching either the house or the senate chambers at the capitol.

Thank you hardwired and OU for bringing this to our attention. I believe OU was the one who gave word of the prestaking issue a year ago. The sooner we know of anti-trapping issues the sooner we can address them. Here is Representative Tymeson's e-mail and phone numbers:

Does anyone know why she is introducing this legislation? I see she is ex-military so should be a pro-gun. She is serving her 3rd term so she isn't a Freshman.
Here we go again guys, time to step up and be heard if we want to preserve furbearer management as we now know it.

I talk with Ron A. about this yesterday and He said that the DNR would not back this. Plus he still thinks it's about the prestaking deal again . I think there is more to this row then prestaking, more like someone's pet in a trap or just anti trapping all together

just left a message on Mrs. Tymesons answering machine...nothing rude just stated who I was and that I was a trapper and a member of the Rep. party and would like to discuss this issue with her and how I thought it was a mistake......I think if we all fill up her machine she could see how us as trappers will not just let this be passed without a fight.....just a thought.

Winterset, Adel, Desoto there are alot of folks from DM that buy acreages and think they own everything. Maybe they have contacted her telling her they don't want people on their ROW's. I have all ready sent my email to her and also the rep for my area.

Riverrat the DNR is NOT!! out too get us as some would think. I admitt they may not be going at somethings as I think they should but they are really and truly friends to the trappers. With out them in our corner we would have lost this whole battle along time ago.

I would say this goes back a year when a dog got snared and died. The owner blamed someone and the DRN contacted the trapper blamed. It was found out through the DNR Officer that the persons dog that died didnot know whos snare it was. The owner of the dog had threated the trapper he blamed over the phone that he would shoot him, lucky for the trappers that the DNR found out who had set the snare and got the whole mess taken care of. I will bet this is where this is coming from, it is a classic case of someone from the city moving out to the country and thinking he can let his dog run loose and then trying to push his view on the rest of us. I will let my brothers know about this as all of them live in Madison Co.

Just wanted share what I sent forward.
Representative Deyoe as a trapper and hunter in your district I am asking that you do not support the bill/house file listed below. I have lived in the area all my life and have trapped, snared and hunted for years. There is already a law in place to keep trappers and hunters from using the road right of way within 200 yards of inhabited buildings whether it be people or livestock. This would not allow us to trap or hunt in road ditches and under bridges without permission from the land owners. I own property (farm ground) and raise a few cattle and do not feel this bill/file would be a benefit to me from a land owners prospective. I do live on the fore mentioned land. Please tell me that you will help out trappers and hunters by not supporting this. I believe there are many other issues that deserve your and others attention more than this one.

Well I must say I had a very interesting talk with Jodi Tymeson and I could tell that she was very miss informed about trapping in road side ditches. She told me that 5 constituents out of some 30,000 complained about trapping row. stated that it was all based on the fear of catching pets or people.....I informed her of the laws currently in place that protects both humans and pet...the body grip trap 200 yd and 5' from fences for snares and coni's.........also told her how row trapping was a useful tool for animal control and for example I asked her how much the state dept.. of roads spends on beaver dam removal ,which she couldn't answer and stated that she was not on the save the beaver campaign. I explained to her that even if the land owner wanted to keep his beaver damming up the flume the trapper had every legal right to remove the nuisance animal where by saving the state from having to pay their workers to remove the darn which doesn't eliminate the problem like trapping does.....she clearly missed the point I was trying to make when I made the above statement . she found herself always going back to that she was not trying to do away with trapping just row trapping......I also informed her about how other states tried doing away with ROW trapping only to find themselves coming back and reinstating it....I explained to her how hard it would be for me to try and get permission from each and every landowner in order to trap the ditch.....I informed her that many farmers will not let you trap there private property due to liability issues, so if they will not give me permission to trap private ground what makes her think that they will give them permission to trap the road way, if they have the law to back their side...........one of the questions she asked me was "so how can I address my constituents when they say but my dog or cat runs free" I simply asked her "doesn't Iowa have a leash law".......I also told her that most of the trapper will take this as a personal attack on there rights of being able to trap and that many of us were voting republicans and having one of our own go against us would not go over lightly.......and she went back to "I'm not doing away with trapping spiel".......She seemed to think that the bill would not go far as it still had many steps to go before it was passed..... I told her in no uncertain words that I would fight her bill until it was DEAD!........all in all Do I think that she will pull the bill ...NO ...do I feel she is a little more informed....YES, and that is the first step to enlightenment ,is to first to become informed
I was very polite but strong on my stance for trapping and I found her very defencive in her decision to start the bill
I would encourage all of you to talk to her on the phone .....I think that getting my point across becomes more personable then simply a letter....but that just my opinion!

good job Hillbilly. Maybe if the pet thing is brought up again - well if a person really cares for their pet they don't let them run take for example people with pets near a hwy or high traffic areas they dont let their pets run way because the chance of getting hit. Educate the people
